FAMILY CASES

Success Story: A Divorce realized in Circumstances of Violence and Family Abandonment

Case Background

Our client, Mrs. Th. Z, had married citizen P.Z in 1993. During joint life, the couple had two daughters and for a period lived in emigration in Greece. However, since 2010, when they returned to Albania, relations between spouses deteriorated significantly, due to lack of financial contribution from the defendant and deterioration of his behavior, to the point where the situation became unbearable for the client.

The deterioration culminated with the use of physical violence by the husband, forcing Mrs. Th.Z to leave again for Greece, this time only with two minor daughters, in search of a quieter and safer life.

Legal Actions

With the lawyer's help, a lawsuit for marriage dissolution was prepared and filed in Court, accompanied by requests for:

  • Acceptance of the lawsuit
  • Dissolution of marriage with defendant P.Z
  • Return of maiden name for Mrs. Th.Z

In the judicial process, the defendant did not appear in any of the hearings, which reflected lack of interest in protecting the marriage or responsibilities towards the family. Meanwhile, the client stated that she does not accept resolution through reconciliation, emphasizing the desire for a complete and final separation.

Court Decision

The First Instance Court decided:

  • Acceptance of the lawsuit request
  • Dissolution of marriage between parties
  • Allowing return of maiden name for plaintiff
  • Court expenses to be covered by court
Result and Value for Client

Thanks to careful legal representation and protection of her rights, Mrs. Th.Z managed to break away from a violent and hopeless relationship, finally securing her independence and dignity.

This case shows that law and justice are available to those who have the courage to ask for help, and the lawyer's role is key as in every process.
