Success Story – Legal Success in Protection of Dignity and Public Figure

In one of the most important cases of the year in the field of civil law and media, lawyer Kastriot Frashëri managed to secure a significant victory for his client, N.N, establishing an important precedent in the protection of honor and reputation of public figures against denigrating publications.

Case in essence

Mr. N.M, a well-known entrepreneur and former politician with social influence, became the subject of a publication in a newspaper in Tirana which, according to the lawsuit, contained untrue information and slanderous insinuations. In the article, the plaintiff was presented in a manner that severely infringed his image as a citizen, professional, and community leader.

In the absence of any reaction for correction or denial from the media side, he turned to court, represented by lawyer Kastriot Frashëri, to seek justice and compensation for the moral damages caused.

Strategy and legal argumentation of lawyer

In this case, the lawyer built a balanced legal strategy between:

  • Protection of the dignity and personality of the client; and
  • Respecting the principle of freedom of the press, as a fundamental right guaranteed by the Constitution and the European Convention on Human Rights.

Relying on articles 608, 609, and 625 of the Civil Code, the lawyer argued before the court that the publication in question:

  • Constituted an illegal act committed with guilt;
  • Had caused non-pecuniary damage in the form of infringement of honor, reputation, and moral integrity of the client;
  • Created a direct causal link between the publication and the severe psychological and social consequences for the plaintiff.

The lawyer also emphasized that the defendant, as publisher and media manager, had a legal obligation to prevent and correct untrue publications, referring to article 609 of the Civil Code and principles of professional responsibility of the media.

Thanks to in-depth legal analysis and international references — including the Universal Declaration of Human Rights (article 29) and the European Convention on Human Rights (article 10) — the lawyer managed to place at the center of judicial debate the principle that:

“Freedom of expression is a fundamental right, but cannot be used to infringe the honor and reputation of others.”

In this way, the case took values beyond the individual dimension, becoming a test case for media ethics and the limits of civil liability of news publishers.

Result and impact

With detailed argumentation in the lawsuit request, documentary evidence, and clear interpretation of legal provisions, lawyer Kastriot Frashëri managed to convince the court about:

  • The existence of non-pecuniary damage caused;
  • The civil liability of the defendant; and
  • The need for fair and proportional compensation.

The plaintiff requested compensation in the amount of 50,000 euros, as well as publication of a denial and removal of the article from online circulation, to stop further spread of moral damage.

This legal action was appreciated as an example of proper use of judicial mechanisms for protection of a public figure, without infringing freedom of the press, setting a new standard in Albanian jurisprudence for defamation cases in the media.
